Famine, Affluence, and Morality Essay

Whilst reading Singers ideas of a global village in which a person is obligated to aid someone in need regardless of proximity, has moral bearing, but also portrays a rather one sided view of what we consider as â€Å"helping† other starving nations in need. For example, approximately 1 in 8 Americans live below the poverty line, in saying this; the question comes to mind, why we should be concerned with poverty in other nations without first worrying about our own problems. When presented with Singers views concerning helping other third world nations and the guilty spirit he implies through his article, it is imperative that the reader not get so wrapped up into what’s best for the global community and start thinking what’s best for each sovereign nation. I do not fully disagree with the points presented by Peter Signer, but, I feel that industrialized nations such as America are facing their own problems that must be resolved first before we can start worrying about other nations. For example, American families are being forced to pay interest on a debt that was created out of thin air, by this I am referring to the current economic institution known as the Federal Reserve which has been a â€Å"thorn† in the side of every taxpaying American, it was the federal reserve act of 1913, which would force the American people into Inflation, Deflation, never ending debt, slavery, and bondage through money created out of thin air and sold to the treasury, at interest, for its bonds, which are guaranteed by the American taxpayer. According to the Human poverty index, the United States ranked 16th, which is one rank below the United Kingdom (Thoren & Warner, pg. 23). I feel these problems should be solved first, before we concern ourselves with what is happening with other countries around the world. Whilst arguing what I feel will be of the most benefit to the country in which I live, I feel that once these problems are solved, it would be wise to help other nations, not just because of the business relationships that could develop through such processes, but also because of the global image such feats would produce. For example, during World War two, America developed a weapon that’s strength was unknown until its time, the Atomic Bomb. The Atomic Bomb was dropped on Hiroshima in 1945, and in an effort to reduce tension between the United States and those notions within the region of Hiroshima, the United States helped rebuild Hiroshima. The point in all this being that by helping other nations the United States can acquire new allies and develop lasting business relationships. Furthermore, Peter Singer claims that although there is a common distinction between duty and supererogation, this does not justify such a distinction. I feel that it is morally right to contribute to those nations which are less fortunate than we are, but this view of morality must be in accordance with a moral code the ordinary man can relate to. For instance, the ordinary man, being asked to do things he/she considers unnecessary, could result in a general breakdown of compliance amongst the citizens of that particular country. As stated earlier, there must be a balance between the amount of aid we permit other countries to have, and the amount of aid we give ourselves. How can one nation help another, if that nation is suffering from the same conditions? It is imperative to the survival of America that its economic system is sound, and its industry provides enough decent paying jobs for its citizens. Considering Americas current situation, I strongly feel that certain major problems, such as unemployment and the country’s economic system should be the first priority, then helping other countries in need would be the second most important priority. Singer’s article contains many parallels with the pervious viewpoints discussed, on page six he state â€Å"We ought to be preventing as much suffering as we can without sacrificing something else of comparable value (Singer, pg 5).† This statement contains much wisdom. Singers view point considering those citizens who have accumulated extraordinary amounts of wealth, and the need for them to give there surplus wealth to the less fortunate closely resembles the theology of many religious institutions. While although I believe that those citizens that are more fortunate than others should be more swayed to donate an amount greater than those individuals who are less fortunate, I do not believe they should be obligated to do so. If those individuals, who worked hard, and accumulated an extraordinary, amount of wealth, were forced to donate more than those who are less fortunate, the system itself would be incredibly flawed. Many people forget that many of those individuals who have accumulated vast amounts of wealth did so through running a successful business, which, in some instances, employs a great number of people. When forcing such individuals to donate more, employee wages could be affected. In conclusion, while I do not agree with every point made by Mr. Peter Singer, I feel that helping developing nations is an essential aspect in developing peaceful relationships amongst nations. Furthermore, it is essential that citizens involved in helping developing countries should not be forced to pay more than they can afford without reducing their standard of living. It is imperative that underdeveloped nations receive the help needed, but also the citizens contributing to those nations donate an amount that can be agreed upon. References Thoren & Warner. Iliad Book 1 Achilles Vs. Agamemnon Essay

In Homer’s, The Iliad, Book 1, â€Å"The Rage of Achilles,† one of the main concepts presented is the idea that the gods desire honor and glory. It is very evident that both Achilles and Agamemnon are in competition for more power and dominance. This idea is demonstrated primarily through the two prize women, Briseis and Chryseis, daughter of Chrsyses. While the Trojan war was going on, both Achilles and Agamemnon had a fight amongst themselves, rather than focusing on the war going on around them. Achilles claimed Briseis (the more desired of the two girls) and Agamemnon claimed Chrysies. Agamemnon really wanted Briseis because he believed he deserved her for being the chief of the Achaean forces, but by claiming Chrysies, Agamemnon was able to plot against Achilles. Chryses did not want his daughter to be in the hands of Agamemnon, so he begged and pleaded to Apollo to help in getting back his daughter. Apollo sent a plague on the Greek people, and Agamemnon then announced to Achilles that he would only give back Chryseis if he could have Briseis. This made Achilles very angry because he too believed that he deserved Briseis. Achilles was more concerned about keeping Briseis in order to look better, than making peace of the situation and trading Briseis for Chryseis. This showed how important it was to have honor and to appear in control. They put their desires for person honor and glory above the fact that there was a serious war going on around them by putting more focus on who would win the better of the two girls, overall reflecting the theme of dominance and control.

The more organized and efficient the different components in the business are, the better it functions. Herzbergs two factor theory encompasses dual factor motivation-hygiene as it portrays two different factors. Hygiene factors: related to the context of the job Motivational factors: related to the content of the job Research in the 1950 Herzbergs two factor theory asked people to describe situations in which they found their job exceptionally good or bad. Research conclusion; Job satisfaction intrinsic factors. Builds high level of motivation and stimulates superior performance. Dissatisfaction extrinsic factors. Environmental as well as external factors to the job build a zero level of motivation if maintained. Herzbergs two factor theory research evidence also states that the theory fails to; Account for individual differences Link motivation and needs to both satisfaction and performance Consider cultural and professional differences 3. Alderfers ERG theory was developed by Clayton Alderfer and his theory collapses Maslows five categories into three categories: existence needs, relatedness needs and growth needs. ERG theory states that more than one need category may be activated at the same time. Existence needs the desire for physiological and material well-being Relatedness needs desire to satisfy interpersonal relationships Growth needs desire for continued personal growth and development The ERG theory research evidence is encouraging because it offers a more flexible approach to understanding human needs. The comparison of content theories is very interesting to analyze as it gives a more precise breakdown of theories put together. Figure 1 below is a depiction of all three theories put together. This process illustrates how people choose behaviors to satisfy their needs. Victor Vrooms expectancy theory states that a persons motivation is a multiplicative function of expectancy, instrumentality and valence. Expectancy is the probability assigned by an individual that work effort will be followed by a given level of task accomplishment. -Instrumentality is the probability assigned by an individual that a given level of achieved task performance will lead to various work outcomes. -Valence is defined as the value attached by an individual to various work outcomes. Vrooms expectancy theory has various implications as regards motivation. -Motivation is sharply reduced when expectancy, instrumentality or valence approach zero. -Motivation is high when expectancy and instrumentality are high and valence is strongly positive. The expectancy theory has been seen to have managerial implications where as managers should be seen to act to maximize expectancies, instrumentalities and valence that support various organizational objectives. Research evidence on the expectancy theory has received substantial empirical support though the multiplier effect is subject to some question. It may also be useful to distinguish between extrinsic and intrinsic rewards. The expectancy theory does not specify which rewards will motivate particular groups of employees thereby allowing for cross-cultural differences. Lastly, the Porter Lawler model tries to establish a relationship between the efforts, performance and satisfaction of an individual. The most important variables in this model include effort, performance, rewards and satisfaction. In todays digital age, a large number of employees are well educated to some acceptable standard and for that most demand a reasonable salary as well as worthwhile working conditions. As motivation has conformed to some socially acceptable standards of behavior, it has been assumed to be an individual perspective. Every individual is unique because we have different desires, potential, values, goals and attitudes. The most important aspect that most employees are concerned with is their needs and wants. Todays managers have a challenge or the opportunity to influence the motivation of their employees through the design of their performance charters. Well outlined performance charters help accomplish two important goals: getting the necessary work done in a timely and competent manner, motivating and challenging employees. Both the organization as well as the employee is a beneficiary of a successfully done performance charter. Performance charter is the specification of the contents, methods and the counter relationship of jobs to fulfill organizational requirements. Mostly, employees are motivated when they are lead to accomplishments of which they can proud whilst recognizing what they have done. Warren Blank (2001) states that, â€Å"a motivational environment enables people to feel like winners†. Todays performing managers have the responsibility of designing employee performance charters. If a manager ignores this responsibility, employees will definitely design their own. It wouldnt be a surprise to see that performance charters designed by employees are more likely to be adjusted to their experiences and preferences than to the goals of the organization. It has been said once before that you cannot motivate anyone but you can provide the environment in which they can grow to their full potential. Management by objectives (MBO), â€Å"is a style or system of management that attempts to relate organizational goals to individual performance and development through the involvement of all levels of management†, encompasses time period with feedback as well as goal progression. According to Laurrie J. Mullins, the phrase ‘Management by Objectives (MBO) was first introduced by Peter Drucker in 1954 as a strategy for managing people whilst focusing on teamwork based on their ability to complete individual as well as team goals. MBOs have been seen to be effective as it helps in the alignment of an employees efforts around an organizations collective objectives. The MBO process begins with an organization defining its objectives. This is where the process of strategic planning, goal setting, visioning which generates from its process a set of objectives that the organization should always strive to achieve. The main principal underlining Management by Objectives is mainly to create empowered employees who will have clarity of the roles and responsibility expected from them, and once the objectives set are understood, it helps in the achievement of personal as well as organizational goals. Some advantages of MBO include specifically ‘clarity of goals. With clarity of goals, came the birth of SMART goals concept which Intel Specific various key factors should be present in the set objectives for them to be effective. This is where the word ‘specific is outlined because this simply describes specifically the desired results. Measurable This simply states that the objectives should be clear as to whether the objectives were met. Achievable when objectives are set, it should be seen that they are achievable. Realistic Realistic objectives in its own right is explained as goals or objectives that can be achieved coupled with the tools at an employees disposal to achieve the said objectives. Time based time based simply means a set objective has a time frame attached to it which acts as a guideline. SMART objectives ensure the delivery of greater results because they clearly and specifically address performance goals rather than broad emotions or behaviors. This concept also requires that objectives are created in collaboration with supervisors so as to be aware of their subordinates goals and supportive of their completion as well as ongoing tracking and feedback in the process to reach desired objectives. As noted in Robbins and judge, â€Å"MBO popularity should not be construed to mean that it always works†. This is normally as a result of lack of commitment by management as well as the inability in allocation of rewards based on accomplished objectives. Management by Objectives therefore, can be as a process of determining exactly what an employee is to do on the job, the tasks, duties, responsibilities, decision-making and the level of authority. The challenge being faced by managers now is that of employing the new strategies with all its opportunities in ways which not only meet an organizations needs but also the expectations as well as aspirations of the employees. There are several indicators, which can help us to outline the strength of our leadership. The most important leadership quality that one needs to exhibit in todays world is ‘honesty. A leader should always be honest to his task, his products or services, his people and most importantly to his customers. This quality of leadership should not only exist but also should be seen to exist in by all stakeholders in the organization. John C. Maxwell in an extract of his book by George Wells states that, â€Å"while leaders need to connect publicly with large groups of people, the same thing needs to happen on a one-to-one basis between individuals. Maxwell tells how his staff used to groan when he would say People dont care how much you know until they know how much you care because he quoted the saying so often, but it is true. You develop credibility with people when you connect with them and show that you genuinely want to help them. Everybody wants to be somebody† If you treat every person you meet as if he or she were the most important person in the world, youll communicate that he or she is somebody to you. Of course, the respect needs to be genuine at all times otherwise people will rapidly sense that they are being manipulated otherwise. Dennys Restaurant management should have been able to realize that customer complaints are company failures and these require immediate attention. Ultimately, spending money in hopes of making money is an organizations goal but every dollar paid out to offset various customers who were dissatisfied is a signal that an organization must change in some decisive way. The Vidsoft Triangle Every little thing we do has positive, negative or neutral impact on teams motivation. Vidsoft case is one among the few companies that come across case of team based management problems that are faced by employees. Analysis of Vidsoft Vidsoft technologies was an internet company designing enterprise software and in June 1999, its quarterly revenues grew from $50M to over $250M year ending 2000 while employee base rose from 500 to 2,000. Babatunde graduated from Darden graduate of business administration in may 1998. He moved to California to get a job with Vidsoft technologies as senior technical support engineer. Alex Hsu was employed as technical support engineer and reported directly to babatunde. Even though Hsu was not good at team work, he was hired to bring varied culture as well as experience to vidsoft due to his previous record Babatunde made a public decision of promoting one of his engineers to be manager. Hsu reported some displeasure about his new supervisor Jennah Li as she was deemed to be an inexperienced manager and babatunde was unsure of what decision to make as he was the overall among the two despite having fears about taking sides. Keith Nash as CEO of vidsoft developed a culture that encourages its employees to speak their minds as excellence of employees was followed with promotions. Vidsoft as an organization encouraged teamwork and thus were awarded bonuses for collectively working together. Keith Nash believed in the culture of promoting from within as a motivational tool for employees until after vidsoft went public because this brought a mass influx of talent as well as wages became high. Vidsoft ended up falling back on its employees in terms of hiring due to costs so as to train them to keep up with the pace. Babatunde initially employed a micro-management style of management where he kept a close eye on all his employees in hopes that his team succeeds but this had to change as employee numbers rose. He then changed his style of management by using set objectives for each team to achieve desired goals. As babatundes responsibilities grew, he saw it necessary to change his reporting structure to reduce the number of people reporting to him so to manage more effectively. This led to him promoting one of his engineers ‘Jennah Li to manage one of the product lines. Jennah Li in regards to Hsu was hired for her skills in managing customer relations despite English not being her strength; she was awarded for being the best team player. In vidsofts operational history, White was one of the first employers to run the technical support department and set stringent goals to be met by his fellow employees. He took an active role in ensuring that any team under his command did well to meet his standards. James White made a decision to hire babatunde because of his MBA training and trusted him to an extent of giving him all powers to make various decisions affecting the organization with his guidance. THE SOLUTION Babatunde at this point should be able to realize that workplace conflicts and unresolved differences can be the cause of negative performance of teams or generally employees. Furthermore, existing physical and psychological differences can escalate if conflict remains unaddressed by vidsoft managers as well as team members. From the onset, babatunde was aware that Hsu was not a team player and this should have been a starting point of making things clear to him that for him to succeed, he had to work in collaboration with other team members. It was observed that being a team player for Hsu as observed is a road he hasnt travelled and requires some skill and effort from babatunde. Hsu should be made to realize that teamwork is about assuming positive intent and seeing things from all sides in detail. Everyone has unique gifts and abilities. Recognizing these and appreciating them can be very useful especially in the case of two people with different skills because they can complement each other very powerfully when they work together. Its about acknowledging and accepting differences, and exploring alternative solutions that meet everyones needs and concerns as it is important to everyone, and all sides ‘Hsu and Ali need to be committed to the solution. Both parties should agree that the goal is to fix the problem not to assign blame, hurt, humiliate, or threaten the one another. Babatundes job now is to focus on the issue, present and future, and on solutions available. They should be made aware that the situation must change and identify consequences if it does not. Keith Nash as CEO of Vidsoft should make things clear from the onset of employment that individuals are different at times as regards to each others needs. Sometimes workplace issues are evaded or ignored completely but generally, this is not a useful long term solution as the workplace is never small enough to avoid someone completely. Some guidelines should be put in place to for conflict resolution. Every employee upon being taken under vidsoft should be made aware that; Conflict and grievances are present within the workplace Improved communication within the workplace will avoid conflicts Establish performance expectations and consequences if expectations are not met. Lastly Vidsoft should have a written resolution and agreement regarding behavior within the workplace which should be adhered by both the employer as well as the employee. Babatunde should provide the leadership that enables his teams to productively work together and as much as possible, work with employees individually and encourage them to address the conflict directly with each other.

Stop and search, and the Human Rights Act

Stop and search, and the Human Rights Act PART A The power of stop and search is a general term used to describe the powers of police or occasionally the officials to search the members of public in a various context without a warrant.[1] Such powers are governed primarily under Part 1 of the Police and Criminal Evidence Act 1984 (PACE). [2] Besides PACE 1984, there are other legislation which governs the power of stop and search. For example, s23 of the Misuse of Drugs Act 1971[3], s60 of the Criminal Justice and Public Order Act 1994 (CJPOA)[4] and s47A of the Terrorism Act 2000 (TACT)[5]. The power of stop and search under TACT were previously governed under s44, but were ruled illegal by the European Court of Human Rights, stating that the power were too widely drawn and open to abuse.[6] S44 were than formally replaced with s47A by the Terrorism Act 2000 (Remedial) Order 2011[7] on the 18 March 2011, by more limited measures in England, Wales and Scotland. All legislations which governs police power of stop and search similarl y aim to prevent and deter crimes, however, there is still some difference in the regulations of such powers, between Part 1 of the PACE 1984 and s47A of the TACT 2000. Statistic showed that approximately 1.1 million stops and searches are recorded under Section 1 of the PACE 1984, in the year of 2011/2012. [8] No searches were made by the police in 2011/12 or 2012/13 in Great Britain under s47A of TACT.[9] A low detection rate alone does not necessarily undermine the use of stop and search powers. Proponents of the power, especially under terrorism legislation, argue that its use disrupts and deters criminal activity rather than simply detecting it.[10] The first and utmost obvious difference in the powers of stop and search in relation to both PACE 1984 and TACT 2000 are that both legislation have different aim of search. Part 1 of the PACE 1984 provides power to stop and search for a range of items including stolen property, offensive weapons, prohibited articles under s1(7) PACE, controlled drugs or evidence that a person is a terrorist.[11] Whereas, powers under TACT 2000 were to search for evidence of terrorism. An officer exercising the stop and search powers may only do so for the purpose of searching for evidence that the person concerned is a terrorist or that the vehicle concerned is being use for the purposes of terrorism, as opposed to the purpose under section 45(1)[12] of searching for articles of a kind which could be used in connection with terrorism. [13]. The meaning of terrorists are defined under section 40(1) (b) of the 2000 Act. In addition, the regulation of the power of stop and search are different in terms of the powers where exercisable. Under Part 1 of the PACE, the power of stop and search may be exercise by constable at any time, but only in public places, and non-dwelling places to which the public have ready access.[14] This includes public transport, museums, sports ground, cinemas, pubs, restaurants, night club, banks and shops. Whilst power of stop and search under S47A only allows a constable with uniform to search at a specific area for a defined period [15]with authorisation by an officer of ACPO rank who reasonably suspects that an act of terrorism will take place.[16] Next, the difference of regulations of both PACE and TACT in the power of stop and search by the police are the matter of authorisation. Under Part1 of the PACE, the constable are allow to conduct searches as long as they are having the reasonable ground of suspicion that relevant offences will be found. [17] There are no mention of needing authorisation by officer of a higher ranking before conducting stop and search unlike S47A of TACT. Under this section, authorisation by a senior police officer are essential before stop and search could be conduct by any constable in uniform. [18]Authorisation will only be given if an officer reasonably suspect that an act of terrorism will take place[19] and consider that the authorisation is crucial to prevent such an act and that the areas or places specified in the authorisation are no greater than is necessary and the duration[20] of the authorisation is no longer than is necessary to prevent such an act. The requirement for an authorisation are given in the Code of Practice[21] where an authorisation under section 47A may only be made by an officer of ACPO or ACPOS rank. The authorisation would include details of how the exercise of the powers is necessary to prevent the act of terrorism.[22] In most statutory provisions including PACE which grants police the power to stop and search, there is a requirement that the police must have a reasonable ground of suspicion that the person is in possession of an item of a specified kind. [23] Although there was no definition of reasonable ground of suspicion laid down in the legislation, Code of Practice A, under PACE had provided some sort of guideline as to what constitute reasonable suspicion. Para 2.2 explained that reasonable grounds for suspicion will depend on the nature in each case. [24] There must be some objective basis for that suspicion based on facts, information and/or intelligence that are relevant to the likelihood of finding an article of a certain kind.[25] Reasonable suspicion can never be supported on the basis of personal factors. Officers must rely on intelligence or information about or some specific behaviour by the person concerned.[26] For example the nature of the articles suspected of being carried, th e time and place where the person or vehicle is or the behaviour of the person suspected. The case of Howarth v Commissioner of Police for the Metropolis (2011)[27] explained that reasonable cause for suspicion is a lower standard that which would be required to establish a prima facie case.[28] It allows police officer to take into account matter that would not be admissible as evidence. In comparison, the power conferred under S47A TACT 2000 can be exercised without reasonable suspicion. An authorisation by a senior police officer allows searches by any constable in uniform in specified areas or places without reasonable suspicion to find evidence related to terrorism. The authorisation would provide explanation which allows stopping and searching of individuals and/or vehicles without suspicion is necessary to prevent the suspected act of terrorism.[29] To conclude, although both PACE and TACT have different regulations in terms of the power of stop and search, however what remains the same is that the underlying principles of stop and search are intended to promote its use in a fair and effective manner. An officer may not search a person where there is no legal basis to do so, even with an individual’s consent. Stop and search must be done in a courteous and respectful manner and the length of detainment must be kept to a minimum even when the officer is lawfully entitled to search a person of vehicle. [30] PART B The Human Rights Act 1998 (HRA) came into force in the United Kingdom in October 2000. [31]This legislation gives effect in the UK to certain fundamental rights and freedoms contained in the European Convention on Human Rights (ECHR). Under section 6 of the Human Rights Act 1998, public bodies such as the court, police, local council and all other bodies carrying out the public functions must comply with the Convention rights. This means, individuals can now take human rights cases in domestic courts and they no longer have to go to Strasbourg to argue their case in the European Court of Human Rights.[32] With the HRA 1998 coming into force, the power of stop and search had made some impact on the regulation and use of the power of stop and search in some way. In relation to the use of power of stop and search, public bodies are required to exercise such power in compliance to the convention rights. The legal framework for protecting the fundamental human rights contained in the HRA 1998 allows the public to rely on the articles when they are being stopped and searched. When powers of stop and searched are exercise, the public bodies are required to exercise it in such a way that it is necessary and proportionate. [33]Article 5, 8 and 14 of the HRA 1998 would be more relevant in the matter of stop and search. Article 5 ensures the right to liberty and security of person. [34]The right in Article 5 is limited, which means that there are certain circumstances or situation where deprivation of liberty is lawful.[35] Article 8 protects people from arbitrary interference in their private and family right. [36] The act of being subject to a search, which may take place in public, and may include a search of a person, their clothing or personal b elongings will interfere with Article 8 rights. Article 8 is a qualified right, and Article 8(2) provides exceptions enabling interference with the right, for example in the interests of national security, or the prevention of crime.[37] Any interference with a person’s Article 8 rights will need to come within one of the exceptions allowed under Article 8(2), and be in accordance with the law, necessary and proportionate. In addition, Article 14[38] allows people to enjoy the Convention rights without any discrimination. In another words, individual must not be stopped or searched purely because of their race or religion. The power of stop and search would only be compatible with human rights if they are used legitimately and proportionately.[39] Evidence shows that stop and search powers that do not require reasonable suspicion, as well as those under PACE, may be used in a way that is discriminatory because certain ethnic communities are more likely to experience stop and search than others. However, the black and minority ethnic groups, particularly the black people, have for many years been disproportionately at the receiving end of police stop and search. Joel Miller in his article ‘Stop and Search in England, A Reformed Tactic or Business As Usual?’ suggested that the treatment towards the black and the minority had always been discriminatory. This is evident in surveys such as the Smith and Gray 1985, Willis 1983, Young 1994, and others. [40]The government statistics particularly from the Ministry of Justice 2009 had suggest that the black people in England and Wales in the year of 2007/2008 are more likely to be searched eight times more than white people and Asian people more than twice, for searches which requires reasonable ground of suspicion.[41] The power of stop and search under Terrorism Act 2000 were previously governed under s44, but were ruled illegal by the European Court of Human Rights in the case of Gillan and Quinton v United Kingdom[42]. After the incident of 911, the Home Secretary and senior police officers established the practice of making authorisations continually under section 44 to cover the whole of metropolitan London.[43] The police justified their act by claiming that there was now a generalised threat of terrorism in London and it was likely to manifest in any large-scale public gathering, and that it would be impractical to make narrower. In this case, Kevin Gillan and Pennie Quinton were attending a demonstration in London in the year of 2003. Both of them were stopped and searched by the police under S44 Terrorism Act 2000. They subsequently brought a judicial review regarding the power of stop and search on the basis that there was no evidence of terrorism showed by the protestor on that day. They claimed that the stop and search was an interference with their rights to liberty, respect for privacy, and the right to freedom of expression and assembly. [44]In March 2006, the House of Lords heard Gillan and Quintons appeal against the refusal of the lower courts to allow their claim. Lord Bingham and his fellow Law Lords ruled that section 44 was itself compatible with Convention rights, there were sufficient safeguards against arbitrary use of the power, and that there was no evidence that the section 44 power had been exercised unlawfully. [45] Gillan and Quinton took their complaints further to the European Court of Human Rights in Strasbourg. In January 2009, the Court ruled that the searches under section 44 had violated their right to respect for their private life under article 8 of the European Convention on Human Rights (ECHR). [46] As a result of a legal challenge made by the European Court of Human Rights, and as a part of the UK government’s commitment to introduce safeguards against the misuse of powers under TACT, the Home Secretary conducted a review of these powers.[47] One of the recommendations of the review was that stop and search powers under section 44 of TACT should be repealed and replaced with a much more targeted and proportionate power. [48] The Home Secretary therefore made a remedial order under section 10 [49] of the Human Rights Act 1998 to make immediate changes to the legislation. This new power came into force on 18 March 2011.[50] Section 47A of TACT allows the police to stop and search persons in order to prevent acts of terrorism, without reasonable suspicion of their involvement in terrorism. Searches under this power may only be authorised in a specific area for a defined period where the police reasonably suspect an act of terrorism will take place.[51] Stop and search powers provided under the Police and Criminal Evidence Act (PACE), the Misuse of Drugs Act 1971, the Firearms Act 1968 [52] and the Road Traffic Act 1988 [53]all require a reasonable suspicion that the person stopped is in possession of prohibited goods or has committed an offence.[54] By contrast, stop and search powers provided under section 60 of the Criminal Justice and Public Order Act 1994 and section 47A do not require any grounds of reasonable suspicion. Although S47A can be said as an improvement of the previous law, however the power of stop and search without reasonable suspicion had always been an issue. Many are in the view that such power of stop and search without the need of reasonable suspicion is inherently incompatible with the Convention. [55]The justification is that the lack of any requirement for reasonable suspicion renders selection for stop and search arbitrary and invites discrimination in the exercise of the power.[56] Rabinder Singh QC, Professor Aileen McColgan and the Human Rights Watch are in the view that the nature of stop and search without the need for reasonable suspicion is incompatible with right to respect for private and family life under Article 8 of HRA 1998.[57] In their view, even with the best guidance to officers as to how to exercise the power, cannot be rendered compatible with Convention rights because of the irreducible arbitrariness of the selection of individuals to subject to the power.[58] In Human Rights Watchs view, the only human rights compatible power to stop and search is one which requires reasonable suspicion. The Equality and Human Rights Commission (EHRC) itself, however, does not appear to share this view that a power to stop and search without reasonable suspicion is inherently incompatible with Article 8 and other Convention rights. [59]In its submission, it recognises that there may be very exceptional circumstances in which it is necessary for there to be a power to stop and search without reasonable suspicion ,for instance to prevent a real and immediate act of terrorism or to search for perpetrators or weapons following a serious incident. [60] In terms of the protection under the power of stop and search, any individual who were searched unlawfully may seek a remedy under the Human Rights Act 1998 for an unjustifiable breach of their rights to liberty, respect for private life or to be free from discrimination. [61] All in all, the Human Rights Act 1998 had made some significant impact on regulations and use of the power to stop and search by the public bodies. It is safe to argue that the law in terms of the stop and search power had improved significantly, particularly S47A TACT 2000, which minimize the abuse of power and act in compliance with the Convention rights. With the legislation coming into force, it does not only provide guidelines to the authorities, it also provides momentous protection to the public when the power to stop and search are exercise on them. In any circumstances which the public authorities abuse or misuse the power to stop and search, judicial review would be a mechanism to hold them into account. It was suggested that, when there is misuse of power, judicial review offers the public a relatively quick, effective and inexpensive means of securing their rights through scrutiny of the lawfulness of police action by a specialist judge. Cultural Diversity Children should be exposed to all segments of society. Youngsters learning with children of different races, nationalities, and religions tend to be more tolerant and accepting of individual differences. They learn customs, beliefs and rituals of classmates that maybe quite different from what they have been taught. Youngsters learning in an environment of diversity are well prepared to deal more effectively in society after they complete their education. A mutual respect and understanding of other cultures removes barriers and stereotypes. Individual differences need to be threatening. In fact, knowledge of other cultures helps a person realize and appreciate the similarities more than the differences. It is most important that the teacher is trained to teach about and respect individual differences. A diverse group of youngsters can add a great deal to the classroom environment. Interaction between children, handled effectively, can promote a climate of curiosity, mutual respect an d acceptance. Nina Rees addressed the topic of teaching styles at both public and private school systems. She suggested students achieve greater results in an environment in which competition and different religious and cultural backgrounds exist. (Rees 93). Richard Wright and Black Boy One main point of the United States Constitution was missing from the Jim Crow South: equality. The Constitution clearly states that "all men are created equal," but in the Jim Crow era blacks were continuously persecuted for something that would be acceptable in today's society. In the early 20th century the South was a place of racial prejudice, discrimination, and hate; blacks could be punished for simply looking at a white person in the wrong manner. Punishments included arrest, beating, even lychings were a common part of the age. This is how life was while Richard Wright was growing up; but in his autobiography Black Boy we learn that despite his being a black boy in the Jim Crow South, born on a Mississippi plantation, he is eventually able to achieve success. Although independence was a crucial factor that enabled Richard Wright to succeed, his rebelliousness, intelligence, and perseverance were also important contributing factors. Richard Wright was an independent person by nature. Throughout the book Richard never seemed to have an extreme emotional attachment to anyone. It was as if he did not need or want anyone's assistance or approval, except his own. Ever since Richard was very young he was forced to be independent. When he mother had her stroke, Richard was forced to take charge and become the person of the house and he would accept no one's help. "Though I was a child, I could no longer feel as a child, could no longer react as a child...When the neighbor's offered me food, I refused, already ashamed that so often in my life I had to be fed by strangers."(pg.97) While Richard was living at his Granny's his independence really started to show through. All Richard ever thought about was leaving to go to the North; especially after being ridiculed for writing his story, The Voodoo of Hell's Half-Acre. No one supported him. He wanted to be able to do what he wanted to, by himself. "I drea! med of going north and writing books and novels."(pg.186) Once Richard was on his own he felt free of the burden, of other people's opinions that had tied him down his entire life. Along with independence, his rebelliousness was another beginning point of Wright's drive to make it in a white man's world. The very first sign we see of the rebel in Wright is when he is only four years old. Terror and Violence in Nazi Germany from 1933-34

How far did the Nazi regime rely on terror and violence to consolidate its hold on power from 1933-34? Although most of the Nazi regime’s policies and actions were legal, the presence of terror and violence towards it opposition and citizens was most likely the key to the Nazi’s staying in power. With the aid of the SS and SA, the Nazis were able to stage coercive elections only allowing us to suggest unreliable results when it comes to answering this question.Hitler was appointed as chancellor on January 30th 1933. On the 27th of February 1933, the Reichstag building broke out into flames, four weeks after Hitler had assumed office of chancellor and weeks before his government had urged President Hindenburg to dissolve the Reichstag. The Nazis were able to convince the general public that this was â€Å"acts of terrorism† by communists. This meant at long last the Nazis could get rid of the KPD and all other political parties, whether they posed a threat or not. The Reichstag fire lead to the emergency decree which seized several rights of the German people such as freedom of opinion, personal freedom, freedom of the press and the freedom to organise and assemble. It also meant the German officials could detain whoever they wanted without a warrant. Three weeks after the emergency decree was announced, the Enabling Act (March 27th 1933) was passed. This gave Hitler the power to pass laws without the interference of the Reichstag or Reichsrat.As Hindenburg was aging he took less interest in day-to-day government activities, hence why he signed the enabling act as it effectively removed Presidential oversight. With the enabling act and the emergency decree both active, Hitler’s government was transformed into a legal dictatorship, allowing the Nazis to do whatever they wanted, however they wanted. The Nazis also controlled the media through propaganda minister, Dr Joseph Goebbels. On the 13th of March 1933, he was appointed head of the Reich ministry which was in charge of all media and public entertainment.On the night of book burning in Berlin, Goebbels condemned all books by Jews, liberals, leftists, pacifists, foreigners, and others as â€Å"un-German. † This lead to Nazi supporters in the educational sector, both students and professors, to burn these â€Å"un-German† books in attempt to â€Å"cleanse† German spirits. With the Enabling Act still active Hitler was able to pass a series of laws called the Gleichstaltung laws. Gleichstaltung means â€Å"coordination† or â€Å"bringing into line†. These laws were laid down to ensure a totalitarian state without any possibleobjection or opposition. They were also put into place to standardize Nazi-German lifestyle. All anti-Nazis were purged from civil service and schools. Gleichstaltung however also consisted of several organisations which were made compulsory. All these compulsory groups set up by the Nazis prepared the chosen gender or age group for life during the war. The Gleichstaltung laws allowed the Nazi’s to commence The Night of the Long Knives, within legal jurisdiction. The Night of the Long Knives was the termination or arrest of opposition to Nazis.Majority of the victims were prominent members and leaders of the SA such as Ernst Rohm and Kurt von Schleicher. Due to unemployment of up to six million, the SA had grown massively and were looking a lot less controllable to Hitler. At one point, the SA were Hitler’s personal army, great tension grew between Hitler and Rohm as they both had a difference of opinion. Another reason the SA was eliminated was due to homosexuality that was rumoured to be present in the group. This clashed with core Nazi ideology and it simply could not be overlooked by the Nazis.President Hindenburg died on the second of August 1934, this lead to Hitler combing the roles of both president and chancellor into one, known as the Fuhrer, giving him complete power over Germany. In evaluation, majority of Hitler’s rise to power was legal and even his acts of violence and terror were legal due to the Reichstag decree being active as well as the enabling act. Even with great election results, we cannot determine whether they were genuine or not due to coercive elections. Therefore it seems most of his rise to power relied on the acts of terror and violence.
